Business terms
Effective date: 20 September 2026
These terms govern the website design, hosting, maintenance, reporting and related digital services supplied by Peak Creative to business customers.
1. About these terms
Peak Creative is a trading name of Ecom Trading, a business registered in the United Arab Emirates. You can contact us at info@peakcreative.site or through the WhatsApp number published on our website.
These terms apply only to customers purchasing our services wholly or mainly for business purposes. Our services are not offered to consumers for personal use.
By accepting these terms at Checkout, paying an invoice or asking us to begin paid work, the customer confirms that it is acting for business purposes, the person accepting has authority to bind the customer, and it agrees to these terms and the applicable Order Form.
2. Definitions
Customer means the business purchasing the Services.
Digital Partnership means the recurring website management, hosting, reporting and support service described in the Order Form.
Initial Term means the minimum 12-month subscription period.
Order Form means the customer’s Checkout page, quotation, proposal, invoice or other written confirmation setting out the agreed Services, fees and any customer-specific arrangements.
Services means the website design, hosting, maintenance, reporting, updates and other services agreed in the Order Form.
Website means the customer-specific website created or managed by Peak Creative.
3. Initial preview
Peak Creative may prepare an initial website preview before asking the customer to make a payment. Unless otherwise agreed, the preview:
- is supplied without charge or obligation;
- is provided for evaluation only;
- remains the property of Peak Creative;
- must not be copied, published, reproduced or used without permission; and
- may be removed if the customer decides not to proceed.
A preview and its associated quotation remain valid for 14 days unless Peak Creative agrees otherwise in writing. If the customer does not proceed, Peak Creative may reuse general layouts, concepts, components and non-confidential ideas developed for the preview.
4. Forming the agreement
If the customer approves the initial preview, it may proceed by accepting these terms and paying the initial fee shown at Checkout or in the Order Form. The agreement and Initial Term begin when that payment is successfully made. Peak Creative will then complete the agreed revisions, final preparations, domain connection and Website launch.
5. Scope of the website build
The initial Website build includes only the pages, content, functionality and deliverables described in the Order Form. Unless agreed otherwise, it includes a Website designed around the customer’s business, responsive layouts, agreed business information and contact options, launch preparation and up to two reasonable rounds of consolidated revisions before launch.
A revision round means one consolidated set of reasonable comments. It does not include a complete redesign, a change of the original brief or substantial new functionality.
6. Customer responsibilities
The customer must provide accurate and complete information, content, images, approvals and account access reasonably required to deliver the Services. The customer is responsible for:
- checking its services, prices, qualifications, contact details and business claims;
- ensuring supplied photographs, logos, text and other materials may lawfully be used;
- reviewing the Website before launch;
- maintaining access to its domain, business email and relevant third-party accounts;
- responding to reasonable requests from Peak Creative; and
- informing Peak Creative promptly when important business details change.
Delivery dates are estimates and will move where the customer delays content, access, feedback or approval. Approval of the Website confirms that the customer has checked the visible content.
7. Delayed or abandoned projects
If the customer does not provide required information, access, feedback or approval for 30 days, Peak Creative may pause the project. The Initial Term and billing continue during a customer-caused pause because capacity, hosting and associated services have been reserved.
Restarting a paused project is subject to reasonable availability. If the customer remains unresponsive for 90 days, Peak Creative may treat the active build project as abandoned. This does not remove fees already due or obligations under the Initial Term.
8. Digital Partnership
The Digital Partnership begins and is billed according to the Order Form. Where the first month is included with the Website build, the first recurring payment will normally be collected one calendar month after the initial payment.
The service may include Website hosting and management, routine checks, small updates to existing content, monthly performance reporting, review of key business information, available Website and enquiry activity data, Google Business Profile review and reasonable support. The precise Services are those set out in the Order Form.
9. Monthly update allowance
The Digital Partnership includes up to one hour of small Website updates per month. This may include reasonable changes to existing text, images, contact information, opening hours, service descriptions and other existing business details. Unused time does not roll over.
The allowance does not include new pages, major rewrites, redesigns, ecommerce, booking systems, custom functionality, extensive search optimisation or other substantial work. Additional work will be quoted separately and will not begin until approved.
10. Fees and payment
The applicable fees, billing frequency and payment dates are shown at Checkout or in the Order Form. Fees are stated in British pounds unless agreed otherwise. VAT or equivalent taxes will be added only where legally required.
Recurring payments are collected automatically through Stripe using the customer’s saved payment method. If payment fails, Peak Creative may retry it and contact the customer. After seven days Peak Creative may pause updates, reporting and support; after 14 days it may suspend the Website and other Services. Suspension does not cancel outstanding fees or end the Initial Term.
Fees already paid are normally non-refundable once the relevant work or billing period has begun, except where required by law or expressly agreed in writing. Additional work is charged only after the customer approves a separate quotation.
11. Minimum term and renewal
The Digital Partnership has an Initial Term of 12 months beginning on the initial payment date. After the Initial Term, the agreement continues monthly until either party gives at least 30 days’ written notice.
The customer may give notice during the Initial Term, but cancellation will not take effect before it ends. The customer remains responsible for payments falling due during the Initial Term.
12. Cancellation notices
Formal cancellation may be sent by email to info@peakcreative.site or through the WhatsApp number published by Peak Creative. The message should identify the customer, the relevant Website and the requested cancellation. Peak Creative will acknowledge it in writing, and the notice period begins when the message is received.
13. Website position following cancellation
Unless the Website is purchased and transferred under section 14, Peak Creative may take it offline after the paid service and notice period end. The customer continues to own its domain, branding and original supplied materials. Ending the Digital Partnership does not automatically transfer ownership of the Website build, layout, code or Peak Creative materials.
Peak Creative will provide a 14-day wind-down period after the service ends so the customer can complete an agreed transfer or make alternative arrangements. If no transfer is completed, Peak Creative may remove the Website from its hosting.
14. Optional Website buyout and transfer
The customer may request to purchase and transfer the customer-specific Website. The applicable buyout and transfer fee is the amount stated privately in the Order Form or another written agreement.
Before transfer begins, the customer must pay all overdue invoices, any remaining payments due during the Initial Term where an early transfer is requested, the agreed buyout and transfer fee, and any separately approved non-standard transfer charges.
A standard transfer includes the available customer-specific Website materials, customer-supplied content and branding, a perpetual right to use and modify the transferred customer-specific Website, and reasonable assistance moving it to a suitable hosting account controlled by the customer. Peak Creative will normally aim to complete this within 14 business days after receiving all required payments, access and instructions.
A transfer does not include Peak Creative’s reusable templates, systems, internal tools, general components or working methods; non-transferable third-party licences; continued hosting, maintenance, reporting or support; new development; paid third-party subscriptions; or work beyond the standard transfer allowance. Transfers are subject to third-party technical limitations.
15. Domain and account ownership
The customer should own and control its domain, Google Business Profile, Google account, Search Console property, business email and other principal business accounts. Peak Creative may receive manager, administrator or delegated access where required. If Peak Creative registers or manages something on the customer’s behalf, the intended ownership will be recorded in writing.
16. Forms and enquiries
Peak Creative may configure forms so enquiries are delivered to an email address nominated by the customer. Enquiries will normally be sent only to the customer; Peak Creative will not routinely receive or retain a copy.
The customer is responsible for maintaining and monitoring its destination email address, responding to enquiries, using the information lawfully and reporting suspected delivery problems. Peak Creative will use reasonable care when configuring and testing forms, but delivery relies on third parties including hosting, Resend and the customer’s email provider and cannot be guaranteed in every instance.
Standard forms must not collect payment-card information, medical information, government identifiers or other sensitive information unless an appropriate solution is expressly agreed.
17. Privacy, cookies and customer compliance
Peak Creative will include reasonable privacy and cookie functionality appropriate to the agreed Website setup. The customer remains responsible for approving its business-specific privacy information, explaining how it uses enquiries, identifying an appropriate lawful basis, responding to privacy requests, complying with applicable marketing rules and notifying Peak Creative when its data use changes.
Where non-essential cookies or analytics require consent, Peak Creative will implement reasonable cookie controls.
18. Data processing
For personal data processed through the Website on the customer’s behalf, the customer acts as controller and Peak Creative acts as processor. Processing concerns hosting, enquiry delivery, maintenance, troubleshooting, security and reporting. It may include names, business details, email addresses, telephone numbers, messages, device information and Website usage information relating to the customer’s staff, prospects, customers and visitors.
Peak Creative will process personal data only on documented instructions unless law requires otherwise; ensure authorised personnel are subject to confidentiality; maintain reasonable security measures; provide reasonable compliance assistance; notify the customer without undue delay after becoming aware of a relevant personal-data breach; and delete or return data after the Services end, subject to legal requirements and normal backup cycles.
The customer generally authorises Peak Creative to use suitable hosting, email-delivery, analytics, payment, security and technical providers as subprocessors. Where data is transferred internationally, the parties will cooperate in implementing any legally required transfer mechanism or contractual safeguard.
19. Reporting, Google services and search performance
Reporting begins once relevant accounts and measurement systems are connected. Analytics and reports may contain delays, estimates, incomplete information or gaps caused by consent choices, browser restrictions, unavailable accounts and third-party systems. A tracked click is not necessarily a confirmed enquiry or sale.
Peak Creative does not guarantee any particular search ranking, Google placement, Website traffic, enquiries, calls, sales, acceptance of Google Business Profile changes or commercial return. Google and other providers control their platforms and may reject, delay or reverse changes.
20. Hosting, maintenance and availability
Peak Creative will use reasonable care in hosting and maintaining the Website. No online service can be guaranteed to operate without interruption. Availability may be affected by maintenance, internet failures, security incidents and third-party outages. Peak Creative will maintain reasonable security and backup practices but does not guarantee that a Website will never experience unauthorised access, technical failure or data loss.
21. Support
Customers may request support by email or WhatsApp. Peak Creative will normally aim to acknowledge ordinary requests within two business days. Serious Website outages will be investigated as soon as reasonably practical. Response targets are not guaranteed resolution times.
22. Intellectual property
The customer retains ownership of its pre-existing business name, branding, logo, supplied photographs and text, domain and other materials it owns. It grants Peak Creative permission to use them to provide the Services and confirms it has permission to supply them.
Until an agreed buyout and transfer is completed, Peak Creative retains ownership of the Website build and its design, code, layouts and development materials. Peak Creative always retains ownership of reusable templates, general components, systems, tools, techniques and know-how.
23. Portfolio use
Peak Creative may display the customer’s business name, logo, Website link and Website screenshots as examples of completed work. The customer may opt out in writing, after which Peak Creative will remove the relevant material within a reasonable period. Peak Creative will not present a statement as a testimonial without permission.
24. Acceptable use and suspension
The customer must not use the Website or Services for fraud, deceptive conduct, spam, malware, unlawful products or services, harassment, intellectual-property infringement or content creating a genuine legal or security risk.
Peak Creative may immediately remove unlawful material or suspend a Website presenting a genuine risk. For another material breach that can reasonably be corrected, Peak Creative will normally give 14 days to correct it before terminating.
25. Termination by Peak Creative
During the Initial Term, Peak Creative may terminate for continued non-payment, a serious or repeated breach, unlawful activity, abusive conduct, intellectual-property infringement or a genuine security risk. After the Initial Term, Peak Creative may terminate for convenience with 30 days’ written notice.
If Peak Creative discontinues the Services during the Initial Term when the customer has done nothing wrong, no remaining subscription payments will be due, prepaid fees relating solely to an unused future period will be refunded where appropriate, and Peak Creative will transfer the available customer-specific Website without charging the standard buyout fee. The customer must provide a suitable destination and reasonable cooperation.
26. Changes to fees and terms
Peak Creative may change recurring fees after the Initial Term by giving at least 30 days’ written notice. The customer may cancel before the new fee takes effect, subject to the applicable notice period.
Peak Creative may update these terms by giving reasonable notice of a material change. A change will not retrospectively alter agreed fees or remove accrued rights. The version accepted at Checkout applies until an updated version validly takes effect.
27. Liability
Nothing in these terms excludes liability where it cannot legally be excluded, including liability for fraud or deliberate misconduct.
Subject to that qualification, Peak Creative will not be liable for indirect or consequential loss; loss of profit, revenue, opportunity or anticipated savings; lost enquiries or contracts; reputational damage; actions by third-party platforms; customer-supplied errors or unlawful content; or events reasonably outside Peak Creative’s control.
Peak Creative’s total aggregate liability arising from the Services will not exceed the total fees paid by the customer during the 12 months preceding the event giving rise to the claim.
28. Confidentiality
Each party must protect confidential business, commercial and technical information received from the other and use it only to perform or receive the Services. It may be disclosed to personnel or providers who need it and are subject to suitable confidentiality obligations, where the other party agrees, or where legally required.
29. Events outside either party’s control
Neither party is responsible for delay or failure caused by an event reasonably outside its control, including major internet outages, natural disasters, government action, war, civil disruption, widespread cyber incidents or failure of an essential third-party platform. The affected party must communicate reasonably and resume performance when practical.
30. Disputes
The parties will first attempt to resolve a dispute in good faith. Before formal proceedings, each party should provide written details and allow at least 30 days for discussion unless urgent legal action is reasonably necessary.
These terms and the agreement are governed by the laws of the United Arab Emirates. The courts of the United Arab Emirates having jurisdiction will determine disputes unless the parties agree another process in writing.
31. General provisions
The Order Form and these terms form the entire agreement concerning the Services. A customer-specific provision expressly agreed in the Order Form takes priority over these general terms.
The customer may not transfer the agreement without Peak Creative’s written consent. Peak Creative may use suitable employees, contractors and service providers. Nothing creates an employment relationship, partnership, joint venture or agency. If part of these terms is unenforceable, the remaining provisions continue. A delay in enforcing a right does not waive it.
Electronic acceptance, Stripe Checkout records, emails and WhatsApp messages may be used as evidence of the parties’ communications and agreement.
